The American Hospital Association and Association of American Medical Colleges submitted an amicus brief to the Supreme Court supporting Vermont's stance in the in the case of Gobeille v. Liberty Mutual Insurance. The state argues that the federal Employee Retirement Income Security Act (ERISA) of 1974 does not supersede the state's law requiring all insurers report claims data to the state. "It is essential that [self-insured plans] be included in all-payer databases if those databases are to realize their potential, and if America's hospitals are to realize their goal of improving community health and controlling costs while providing the high-quality care for which they are known," the brief states.
